Responsbilities of PML and Contributors for Materials held on the ProBleu website:

This Website is operated and hosted by Plymouth Marine Laboratory (PML), a registered UK charitable organisation, on behalf of the ProBleu consortium. It is intended to not only provide access to ProBleu teaching materials to schools and members of the public (Users) but also to allow the same to upload their own materials for the same purpose (Contributors). For this reason PML is responsible for ensuring that copyrighted material is not uploaded to the ProBleu platform without the permission of the copyright holder (the legal owner) of any such materials. This means that if copyrighted material is uploaded by a contributor without the copyright owner’s permission, both the contributor and the platform could be held liable for copyright infringement.

To avoid liability PML will always endeavour to act quickly take the appropriate action, such as removing the infringing material as soon as it is notified of its presence.

If you believe any content you upload may contain any copyrighted material, a good example of this is photographs downloaded from the internet, then you should seek authorisation from the copyright-holders in respect of the content and remove any content for which authorisation is refused or for which you do not get a response. Please note that complying with the above is part of ProBleu’s terms and conditions found below.

Lastly please ensure that any materials you upload on to the ProBleu Website are consistent with ProBleu's aims and objectives found here

ProBleu may provide links to other 3rd party websites, PML do not have control over the content of externally hosted materials linked from this site and cannot be held responsible for the information contained within them. The inclusion of any links does not necessarily imply a recommendation or endorsement of the views expressed within them. Potential Copyright Breaches (Take Down Notices)

If you believe that any materials uploaded on to this website breach your copyright (or any other intellectual property right) please contact legal@pml.ac.uk and PML shall temporarily remove the material as soon as possible, investigate the alleged infringement and then advise what permanent action shall be taken.

Please note that in taking the above action PML cannot be held liable for content uploaded by ProBleu’s Contributors. Please also note that neither ProBleu or PML receive any financial benefit from any content uploaded on to the ProBleu website.

Terms and Conditions

These terms and conditions are split in to two areas, firstly the conditions governing your permission to use ProBleu materials and secondly our permission to hold and use any content you upload on the ProBleu website.

  1. Your Permission to use ProBleu content.

    ProBleu use standard terms and conditions for the provision of all materials provided on its website, including all contributors content, in the form of a Creative Commons Licence created by a 3rd party found here

    The licence enables users to distribute, remix, adapt, and build upon the material in any medium or format for non-commercial purposes only, and only so long as proper credit / attribution is given to the creator. Non-commercial purposes means that the user must not sell or distribute the materials for any kind of financial gain. If you modify, transform, or build upon the material, you must distribute your contributions under the same license as the original.

  2. Permission to use your content.

    This website is designed to let you upload, submit, store, send, receive or share your content. You have no obligation to provide any content to the ProBleu website and you are free to choose the content that you want to provide provided it is in line with the aims of ProBleu. If you choose to upload or share content then it will be covered by the following licence, please make sure that you have all the necessary rights to do so and that the content is lawful. In particular please avoid using any photographs downloaded from the internet as these may have copyright and be subject to a commercial licence, if used without the permission of the copyright holder they may take proceedings to take the picture down and claim damages for using their photograph(s) unlawfully.

    License

    Please also note that by uploading work on to this website you are automatically agreeing to enter into a licence with PML or, in the event the website is hosted by another ProBleu collaborator, its successor. Your content remains yours, which means that you retain any intellectual property rights that you have in your content. For example, you have intellectual property rights in the creative content that you make, such as your own teaching materials or photographs you have taken, alternatively you may have the right to share someone else’s creative content if they’ve given you their permission.

    We (PML or its successor) need your permission if your intellectual property rights restrict our use of your content. You provide us with that permission through this licence.

    What is covered

    This licence covers your content if that content is protected by intellectual property rights.

    What is not covered

    This licence does not affect your data protection rights – it’s only about your intellectual property rights. This licence does not cover these types of content:

    1. publicly available, factual information that you provide. That information does not require a licence because it is considered common knowledge that everyone’s free to use.

    2. feedback that you offer, such as suggestions to improve our services. Feedback is covered in the Service-related communications section below.

    Scope

    This licence covers your content if that content is protected by intellectual property rights.

    1. worldwide, which means that it is valid anywhere in the world

    2. non-exclusive, which means that you can licence your content to others

    3. royalty-free, which means that there are no monetary fees for this licence

    4. non-commercial, which means neither ProBleu nor PML have the right to sell or distribute your uploaded content for any kind of financial gain.

    Rights

    This licence allows the host of the ProBleu website (PML or its successor) to:

    1. host, reproduce, distribute, communicate and use your content – for example, to save your content on our systems and make it freely accessible

    2. publish, publicly perform or publicly display your content, if you have made it visible to others

    3. modify your content, such as reformatting or translating it

    4. sublicense these rights to:

      1. other users to allow the ProBleu website to work as designed, such as enabling you to share your materials or photos with other schools

      2. our collaborators, who have signed agreements with us that are consistent with these terms, only for the limited purposes described in the Purpose section below

    Purpose

    This licence is for the limited purpose of:

    operating and improving the training materials and services provided by the ProBleu website, which means allowing the ProBleu website to work as designed and creating new features and functionalities. This may include using automated systems and algorithms to analyse your content:

    1. for spam, malware and illegal content

    2. using content that you’ve shared publicly to promote ProBleu . For example, to promote training materials, we might quote a review that you wrote.

    Duration

    This licence lasts for as long as your content is protected by intellectual property rights.
